Message Logging and Compliance Form

In connection with Subscriber's use of the ICE Instant Messaging (ICE Chat) service, as governed by the Data Services and Software Services Agreement (the “DSA”), Subscriber elects the following message archiving services (check all that apply):

Subscriber requests that ICE retain Subscriber's message logs for a minimum period of seven (7) years from the date of a respective message generation (the "Message Maintenance Period"). In the event that ICE is unable to maintain Subscriber's message logs for the entirety of the Message Maintenance Period, ICE shall use commercially reasonable efforts to provide Subscriber advance notice prior to deleting Subscriber's message logs.

Subscriber elects to have its respective message logs purged on a rolling basis, minimum of one (1) day, maximum of fourteen (14) days. For the avoidance of doubt, by making this election Subscriber acknowledges that its message log data will not be retained by ICE or otherwise made available to Subscriber in the ICE Instant Messaging archives.

Subscriber elects to have its message logs exported and delivered to Subscriber via the following format and delivery method. Any new user accounts of Subscriber that are added after the execution of this form will automatically utilize the designated export and delivery format, unless ICE is otherwise instructed by Subscriber in writing:

Subscriber requests that ICE export Subscriber's message logs to the Service Provider identified below. Subscriber acknowledges that with respect to any new user accounts of Subscriber added after the execution of this form, ICE will automatically export such Subscriber message logs associated with such new user accounts in the manner specified herein, unless ICE is otherwise instructed by Subscriber in writing:

The Subscriber elects to use the following compliance review tools:

Subscriber elects to use the Enterprise Admin tool for compliance review. Subscriber will submit a list of its compliance administrators and their relevant permissions to ICE Support. New Subscriber users added after the execution of this form will automatically be added to Subscriber's Enterprise Admin system, unless ICE is otherwise instructed in writing.

The following employees of Subscriber are authorized to make changes to the above configuration.

The following employees of Subscriber are authorized to grant message log access to additional employees of Subscriber.

Subscriber will inform ICE in writing if any of the above Authorized Users are no longer authorized to act in the capacity indicated herein. Subscriber acknowledges and agrees that the services offered hereunder are ancillary to Subscriber's use of the ICE Chat Service provided by ICE to Subscriber and are therefore subject to the terms and conditions of the DSA governing Subscriber's use of the ICE Chat Service.
